Federal Court Dismissed Leave Application By A Creditor

After failing in its attempt to claim against the guarantor (Respondent) for the guaranteed sum at the High Court and the Court of Appeal, the creditor applied to appeal to the Federal Court seeking to overturn the decision that the guarantor was discharged after the settlement agreement was reached between the creditor and principal debtor.
The Federal Court has unanimously dismissed the creditor’s leave application.
