Amos successfully defended the Defendant in this case. At the conclusion of the trial, the Court in applying the English case Lumley v. Foster and others [2022] EWHC 54 (TCC) and held, inter alia, that in the absence of written agreement, the parties engaging in negotiation are generally taken as the contracting parties and not the companies which they purportedly control, the burden of proof rests on the party who asserts that he was contracting on behalf of his company.
